    Segways



    Apparently Disney will be allowing disabled people to use segways to get around the parks. Thoughts on this? I feel like it could be dangerous especially with so many children around getting ran over.

    Just curious, but where did you hear that? I heard that they tried awhile ago, but it was turned down

    I think it's just the same with electric scooters, I have been almost ran over by them multiple times.

    If you're disabled, why would you want something you have to stand up on and balance to ride around in all day instead of an ECV with a comfy seat and a basket to put your bag in.

    Segways have a delicate kick stand or have to be leant against walls - and you need a helmet to ride them. And of course they're far easier to fall off.

    And I'm afraid somebody on Facebook saying it came from a court doesn't mean it did. It's just hearsay.

    I'm afraid it's not hearsay. The prior courts finding was reversed and remanded (e.g. overturned) by the appealate court primarily under the grounds that the Segway does qualify as an "electronic mobility device" under the Americans with Disability Act (ADA). The court goes on to state that Disney may ban or limit the use of Segways on their park, but they cannot turn to company policy alone to do so. Rather, they must be able to provide a reason in compliance with "Section 36.311(b) lists several factors to consider in determining whether a device can be used in a particular facility, including the size, weight and speed of the device; the volume of pedestrian traffic in the facility; and whether legitimate safety requirements can be established to ensure safe operation of the device. § 36.311(b)(2). Disney might, for example, permissibly require Segways to travel only as fast as motorized wheelchairs. But any safety requirements Disney imposes “must be based on actual risks and not on mere speculation, stereotypes, or generalizations about individuals with disabilities.” 28 C.F.R. § 36.301(b). "


    The opinion even quotes Uncle Walt at the end!

    Sorry, maybe I didn't word that right. What I meant was reading a report on Talk Disney about what someone said on Facebook about something else is hearsay.

    I prefer to read the facts and don't believe second or third hand reports until I see the facts. There's too many people around that come out with silly stories to believe all that you read!

    I loved your post though - that, for me, is what turns hearsay into fact and makes a story worth reading!

    With the facts, I see that Disney does not necessarily have to let Segways into the parks. The wording of the court order states that...

    We do not hold that Disney must permit Segways at its theme parks. It
    might be able to exclude them if it can prove that Segways can’t be operated safely
    in its parks. Section 36.311(b) lists several factors to consider in determining
    whether a device can be used in a particular facility, including the size, weight and
    speed of the device; the volume of pedestrian traffic in the facility; and whether
    legitimate safety requirements can be established to ensure safe operation of the

    device.

    It'll be interesting to see how Disney reacts now and whether they can find a reason to disallow segways!

    No, I completely agreed with how you put it. When I first read this thread and saw the screenshot of a message post as "evidence", I thought it was hearsay too, so I went to the 9th court's website and looked up the opinion. Sure enough, it's true!

    I can't imagine people zipping around on Segways though. I suspect Disney will require that any users have a speed limiter or something on them. Wasn't the inventor of the Segway killed while riding one and he lost control and flew off a cliff or something?

    Not safe.

    I can't see Disney allowing them in the parks though. ECVs (and even strollers, to an extent) are bad enough. And even the ones used in the tours are extremely modified speed-wise, and helmets are requires. Segways in the parks=unsafe, to me

    Not safe.
    I love segways and think they are very easy to control - but it only takes a moment's lapse in concentration and they can whip round and throw you off. Worse still, if you twist the steering column inadvertantly when you get on, the wheeled base can whip around pretty quickly. In a crowded area, that could do some damage!

    Also, imagine someone falling off a segway and landing on a small child! It really doesn't bear thinking about.

    People can't (or would find it very difficult to) over-balance and fall off an ECV and even if they did, they'd only hurt themselves. Fall from the height of a segway and you can really damage someone else!

    And the whole thing in the court order about being level with able bodied people's eyeline on a segway is rubbish! Have they ever stood on a segway? You'd be wayyy higher than other people!

    I'm all for segway tours at WDW but for me they are a leisure toy which are great in a controlled environment.

    The court order clearly says that allowing segways could depend on "the volume of pedestrian traffic in the facility". Picture Main Street around "The Magic, The Memories and Me" and "Wishes" - it's rammed solid with shoulder to shoulder people all jostling with each other. How can anyone even contemplate the fact that standing on a segway in those crowds could be safe?

    My thoughts exactly, but meh. This is the 9th Circuit. They are known for some goofy (no pun intended) rulings.

    Also, I remembered correctly:

    The multi-millionaire owner of the company that makes Segway motorised scooters has died in a freak accident while riding one of his vehicles. Jimi Heselden, 62, was found dead in a river after plunging 80 feet over a limestone cliff near his home. He was riding a rugged country version of the two-wheeled Segway when tragedy struck.
